Lumi Terms of Service

DRAFT, NOT LEGAL ADVICE. Prepared as a starting point from the app's actual features. Have a qualified lawyer review and adapt it (especially the governing-law, liability, and consumer-rights sections) before you publish. The remaining [PLACEHOLDER]s are operator-specific (legal name, address, competent courts) and must be filled before publishing.

These Terms of Service ("Terms") are a binding agreement between you and [OPERATOR LEGAL NAME] ("we", "us") governing your use of the Lumi habit tracker app and related services ("Lumi" or the "Service"). By creating an account or using Lumi, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 16 years old (or the minimum digital-consent age in your country, and at least 13). By using Lumi you confirm you meet this requirement and can form a binding contract.

2. The Service

Lumi helps you build habits with reminders, streaks, an earnable in-app currency ("Lumen"), a companion character, a meadow/garden, mood check-ins, collectible achievement cards, scripted companion prompts, and sharing / referral features. We may add, change, or remove features over time.

3. Your account

4. Acceptable use

You agree not to:

We may suspend or limit accounts that violate these Terms or harm the Service or other users.

5. Companion guidance and important disclaimer

The companion provides motivational and habit-related prompts selected by automated rules. These prompts are general wellbeing features and may not fit every situation.

6. Virtual items (Lumen, cards, garden)

Lumen, achievement cards, garden/meadow items, and similar in-app items are a license to use features inside Lumi. They:

7. Subscriptions and payments

[INCLUDE THIS SECTION ONLY IF/WHEN PAID PLANS LAUNCH.] Paid subscriptions, if offered, are sold and billed through the Apple App Store or Google Play under their terms. Subscriptions may auto-renew until cancelled; manage or cancel in your store account settings. Refunds are handled by the relevant store under its policy. Prices and features may change with notice as permitted by the store and applicable law. Statutory withdrawal/consumer rights (for example for EU consumers) are not affected.

8. Your content

You keep ownership of the content you create in Lumi (habits, notes, mood entries, and any retained legacy chat messages). You grant us a limited, worldwide, royalty-free license to host, store, process, and display that content solely to operate and provide the Service to you, including syncing it. This license ends when you delete the content or your account, except for limited backups or where the law requires retention.

9. Sharing and referrals

Sharing features (for example collectible cards) and referral links are initiated by you. Anything you share leaves the app and may be seen, stored, or re-shared by others and by the platforms you post to. Share responsibly.

10. Intellectual property

Lumi, including its name, design, art, companions, code, and content (excluding your content), is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes under these Terms. You may not copy, resell, or create derivative works from the app except as the law allows.

11. Third-party services

Lumi relies on third parties (for example Google Firebase, the AI provider, Sentry, Expo, and the app stores). Your use of those services may also be subject to their terms and policies. We are not responsible for third-party services we do not control.

12. Termination

You may stop using Lumi and delete your account at any time in the app (Settings → Delete account), or request deletion at support@lumihabits.app. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive (for example IP, disclaimers, limitation of liability) survive termination.

13. Disclaimers

Except where prohibited by law, Lumi is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will help you achieve any particular result.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of Lumi. Nothing in these Terms limits liability that cannot be limited by law (for example for death or personal injury caused by negligence, or for fraud). [Adjust the cap and carve-outs to your jurisdiction; mandatory consumer protections, e.g. in the EU/Germany, take precedence.]

15. Changes to these Terms

We may update these Terms. We will post the updated version with a new date and, for material changes, give a more prominent in-app notice. Continued use after changes take effect means you accept them.

16. Governing law and disputes

These Terms are governed by the laws of Germany, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes will be handled by the courts of [COMPETENT COURTS], subject to any mandatory consumer venue rights. [The EU Online Dispute Resolution platform and any required consumer-arbitration notices can be added here.]
